By accessing or using GoDAT's services, website, or any related applications, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
GoDAT provides drug and alcohol testing services, including but not limited to:
- DOT and non-DOT drug testing
- Alcohol testing (breath, saliva, EtG)
- Mobile/onsite collection services
- Background screening
- Consortium management
- Compliance consulting
3. User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information
- Maintain the confidentiality of your account credentials
- Comply with all applicable laws and regulations
- Use our services only for lawful purposes
- Not interfere with or disrupt our services
4. Testing Procedures
All testing is conducted in accordance with applicable federal, state, and local regulations. For DOT-regulated testing, we follow 49 CFR Part 40 procedures. Test results are reported to designated employer representatives and, where required, to regulatory agencies.
5. Payment Terms
Payment is due upon receipt of invoice unless other arrangements have been made. We accept major credit cards, ACH transfers, and purchase orders from approved accounts. Late payments may be subject to interest charges and collection fees.
6. Cancellation Policy
Scheduled testing appointments may be cancelled or rescheduled with at least 24 hours notice without penalty. Cancellations with less than 24 hours notice may be subject to a cancellation fee.
7. Confidentiality
We maintain strict confidentiality of all test results and personal information in accordance with applicable privacy laws, including HIPAA where applicable. Information is only disclosed to authorized parties as permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, GoDAT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
9. Indemnification
You agree to indemnify and hold harmless GoDAT, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these terms.
10. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of GoDAT or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
11. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Houston, Texas.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
